1Definitions

• Platform: Refers to the CANCS.ca website, and mobile apps.
• User: Any individual or entity using the Platform, including merchants, and delivery personnel.
• Services: All logistics and software-as-a-service solutions provided by CANCS, including shipment tracking, route optimization, and digital proof of delivery.
• CANCS: Refers to the corporate entity operating CANCS.ca, its parent companies, and affiliates.

2Eligibility and Account Security

• Age of Majority: You must be the age of majority in your province or territory of residence to use this Platform.
• Registration: You agree to provide accurate and current information. You are responsible for any activity that occurs under your account.
• Account Protection: You are responsible for safeguarding your password. CANCS will not be liable for any loss or damage arising from your failure to maintain account security.

3Use of Services

• License: CANCS grants you a limited, non-exclusive, non-transferable license to use the Platform for its intended logistics purposes.
• Prohibited Conduct: You agree not to:
  • Use the Platform for any fraudulent or unlawful activity.
  • Attempt to bypass security features or reverse-engineer the software.
  • Use the Platform to transport prohibited or hazardous goods as defined by Canadian law (e.g., Transportation of Dangerous Goods Act).

4Logistics and Deliveries

• Estimated Times: Any delivery timeframes provided are estimates. CANCS is not liable for delays caused by weather, traffic, labor disputes, or "Acts of God."
• Delivery Completion: A delivery is considered "Successful" if verified by GPS geo-tagging or electronic signature.
• Failed Delivery: If a shipment cannot be delivered due to incorrect information provided by the User or the recipient's unavailability, additional redelivery or storage fees may apply.

5Privacy and Data Usage

• Compliance: Your use of the Platform is subject to the CANCS Privacy Policy.
• Consent: By using the Services, you consent to the collection and use of your location data (GPS) for the purpose of tracking shipments and optimizing delivery routes.
• Data Residency: You acknowledge that data may be stored on servers located outside of Canada and may be subject to the laws of those jurisdictions.

6Limitation of Liability

7Intellectual Property

All content, trademarks, logos, and software code on the Platform are the exclusive property of CANCS or its licensors. You may not use, copy, or distribute any part of the Platform without express written permission.

8Termination

CANCS reserves the right, in its sole discretion, to terminate or suspend your account and access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business interests of CANCS.

9Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by the laws of the province of Ontario and the federal laws of Canada.
• Dispute Resolution: Any disputes arising from these Terms shall be settled through binding arbitration in Toronto, except where prohibited by provincial consumer protection laws.
